...in Order to form a more perfect Union

The first constitution, the Articles of Confederation, was a failure (thought so by those who favored a strong central government, as the states retained most powers, and the national government was merely a league binding them). This created , among other difficulties, trade problems between the states. A convention was scheduled to amend defects in the Articles of Confederation. However, once the delegates convened, the Articles of Confederation was scrapped and work began on drafting a new constitution. The new United States, under this new Constitution, would be more perfect. Not perfect, but more perfect. 

Some have questioned, is the Constitution valid, as the delegates were sent to Philadelphia merely to amend and correct any defects in the old Articles of Confederation, not create an entirely new constitution.  What are your thoughts?
